The Terms and conditions contained herein do not affect your statutory rights as a consumer.
1 - Our Chocolates
All the products for sale on our website are genuinely handmade by us. We only supply our own lovingly made chocolates and no others. Our aim is to supply you with real chocolates, made with the best ingredients available.

Allergy advice:
i) All our products may contain traces of nuts, including peanuts. They are not suitable for nut allergy sufferers.
ii) Dairy Products: The dark chocolate has no dairy products added to it, but we cannot guaranty that it does not contain traces of milk protein. Milk and white chocolates contain dairy products.
iii) Soya: All our chocolates contain Soya Lecithin
iv) Gluten: The wafer praline and crunchy caramel contain gluten.
v) Egg: Our nougat contains egg white.

The contents of our ballotins vary on daily basis and may not be identical to the examples shown on our website. However, we guarantee that our chocolate ballotins are always filled with a selection from our range of fine, real handmade chocolates. Hand moulded chocolate novelties may also have variance in colours compared to these shown on our website. 

2 - Buying chocolates online:
All price quoted include the applicable rate of VAT at the time of purchase. The total value of your order will be displayed on the order confirmation screen. The displayed price is the amount in pounds sterling that you will pay for your goods and Postage and Package.

3 – Secure Payment: 
We accept most major credit and debit cards apart from American Express. 
All orders are processed by Worldpay.   To ensure that maximum security is observed, therefore giving you complete peace of mind while making payment online. 

Payment will be processed at the time of order, not at the time of dispatch. The name and billing address given must be the same as the registered name and address of the cardholder. In accordance with the standing Consumer Protection Distance Selling Regulations (2000) we will email you details of your order and confirmation details of payment.   

4 – Order Cancellation:
Should you wish to cancel your order please contact us immediately on 01227 452222 before it is dispatched and we will issue a refund. An administration charge of £2 may be deducted from your refund. Once your order has been dispatched, payment cannot be refunded. 

5 - Delivery: 
All of our products are offered with a free personal message card.
All our products are freshly handmade to order. Orders are dispatched within 3 working days of your order being placed. Please allow at least 7 working days at peak periods (November, December and 5 weeks prior to Easter). It may be difficult to send an order during the months of July & August when the weather is warmer. (Please contact us before placing your order during that time of year and we shall be able to confirm whether we are sending goods or not.)

Please note we do not offer a same day delivery service and only send to UK addresses UK Delivery Area: United Kingdom includes Scotland, England, Northern Ireland and Wales. We do not dispatch goods on Saturday or Sunday.   All orders are sent using Royal Mail First Class Postal Service. You should allow 2 – 3 working days for delivery.
The Postage and Packing charge is £3.95 per order, whatever the value of your order.
We will send your goods to the address specified by you upon placing the order and cannot be held responsible in the event of the wrong address details being entered by you. Should there not be someone in to accept delivery of your order, a card will be left by Royal Mail, informing the recipient that they have tried to deliver. It is your responsibility to contact your local sorting office to arrange collection or delivery at a suitable date.

Please note that under no circumstances can we be held responsible for the failure of deliveries to arrive on time. No refunds can be given where orders have not arrived on time. We cannot accept liability either if a delivery is not made due to the recipient not being available or not contacting their local Royal Mail sorting office within a reasonable time to arrange collection or re-delivery.
Our chocolates are very carefully packaged in a cardboard box; each item is individually wrapped in tissue paper and/or bubble wrap. This is to ensure that our products reach their destination in good condition.

6 - Refunds:
Should you be dissatisfied with your purchase, please contact us within 24 hours of receipt of your order. We shall make every effort to remedy the situation. Upon receipt of unsatisfactory goods, we will either replace the product by return or refund your purchase monies.  If returning goods to us, please obtain a proof of postage from your Post Office or delivery service provider. Without this we cannot be responsible for any goods that fail to reach us. 
Please note that all refunds from our website are conditional upon return of goods and can only be made to the purchaser of the goods. We reserve the right to decline acceptance of your order at our discretion. Such orders will be refunded to you in full.

7 - Privacy:
We will use your personal details for the dispatching of orders. We may from time to time use your details to send you updates on new products or Madame Oiseau news, this will be done in accordance with the Data Protection Act 1998 and other related laws. We will not sell or share your details with any other company. If you would prefer us not to keep your personal details, please email: contact@madame-oiseau.com.

8 – Our Website:
Madame Oiseau shall not be liable for any damage of any kind suffered as a consequence of using this website. Should any image or document be downloaded from this site, Madame Oiseau Fine Chocolates cannot be held responsible for any computer viruses or other cause of damage to computer equipment.
This website is the property of Madame Oiseau Fine Chocolates. It is for your use for reviewing our product range and purchasing our chocolates. You may browse the website and may download material from this website for your own personal use. Any use of this website for commercial purpose is not permitted. By accessing and browsing this website you accept these terms and conditions without limitation or qualification. The use of this website is subject to the acceptance of these terms and the conditions of use.
